1. Eligibility. This contest is governed exclusively by the laws of the United States and is void outside of the fifty (50) United States and the District of Columbia, and where prohibited, taxed or restricted by law. This contest is open only to legal residents of the fifty (50) United States or the District of Columbia who are thirteen (13) years old or older as of the date of entry. Employees, officers and directors of Sony BMG Nashville, a division of SONY BMG MUSIC ENTERTAINMENT ("Sponsor") and its parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of contest materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers and directors are not eligible to enter.
2. The Contest. Create your own video based on Alan Jackson's song, "Country Boy". You do not have to purchase the song to enter the contest. You can hear the song by clicking on the link: http://www.myspace.com/alanjackson
3. How to Enter. You may enter the contest between 6:00 p.m. Central Daylight Time on September 15, 2008 and 12:00 noon Central Daylight Time on October 6, 2008 ("End Date"). Entries must be received by Sponsor no later than the End Date in the following way: Entry solely via http://www.youtube.com/alanjackson. All submissions must be made in the form of video responses by posting the submitted video to the entrants own YouTube channel and adding them as a video response to Alan Jackson's Contest Video available at http://www.youtube.com/watch?v=-t_4L-n1fpE (the "Contest Video"). Once the submitted video is uploaded, entrants must return to the Contest Video and select "post video response", selecting their video submission. An individual URL for each of the responses will be created and shown as icons in the video response section of the Contest Video.
Limit one (1) entry per person. If more than one (1) entry is received from the same user, only the first entry submitted by that user will qualify for entry in the contest; subsequent entries submitted by that user shall be disqualified. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Delivery of prizes requires a street address (no P.O. Boxes). Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Entries that do not comply with these Official Rules in all respects are ineligible and void.
You shall be solely responsible for your own submission and the consequences of posting or publishing it. In connection with your submission, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize Sponsor to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all submissions to enable inclusion and use of the submission in the manner contemplated by the Sponsor and these rules; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use the submission in the manner contemplated by the Sponsor and these rules. For clarity, all submissions are subject to YouTube's "Terms of Use" (available at http://www.youtube.com/t/terms) and these rules. By submitting the materials contained in your video (the "Content"), you hereby grant Sponsor, its affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, sell, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Content (as such may be edited and modified by Sponsor and its licensees in its discretion) as Sponsor may designate in any medium now known or hereafter devised, for editorial, commercial, promotional and any and all other purposes. You agree that Sponsor owns all right, title, and interest in any compilation, collective work or other derivative work created by Sponsor using or incorporating the Content.
4. Odds/Judging. Winner(s) will be selected from all eligible entries. Odds of winning depend on the number of eligible entries received for the contest. From the eligible entries, the Sponsor will select ten (10) winners following the close of the contest on the End Date. Entries will be judged on creativity, relevance to the "Country Boy" theme, and overall appeal. By entering the contest, you fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the contest.
5. Prize. Ten (10) Grand Prize Winners will each receive: one (1) 8 GB iPod Nano and one (1) autographed copy of the Alan Jackson album "Good Time." A portion of each of the Grand Prize Winners' video footage, the length to be determined by Sponsor, will be included in the final cut of the Alan Jackson "Country Boy" Music Video [Total approximate retail value: $165. Prize is non-transferable. No substitutions or cash redemptions. In the case of unavailability of the prize, Sponsor reserves the right to substitute a prize of equal or greater value.
6. Notification. Winner(s) will be contacted via the "message" option provided on YouTube (requesting winner's email address) and subsequently notified by email and will be required to sign and return, where legal, a Eligibility/Liability/Publicity Release within ten (10) days of prize notification. If winner is considered a minor in his/her jurisdiction of residence, Eligibility/Liability/Publicity Release must be signed by his/her parent or legal guardian. If a winner cannot be contacted within five (5) business days of first notification attempt, if the prize or prize notification is returned as undeliverable, if a winner rejects his/her prize or in the event of noncompliance with YouTube's "Terms of Use" and these contest rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given.
7. Conditions. Entries are accepted and the prize awarded on the condition that all entry materials are the sole property of the entrant and that they have not been accepted for publication elsewhere. Entrants grant the Sponsor all rights of ownership, reproduction, and use of entries for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign use, publish, alter, or otherwise exploit the use of their names, voices, likenesses, statements, any biographical information they provide, and/or photographs and video footage taped during the event without notice, review, or approval; and to the announcement/use of their names, voice, image, and/or likeness for trade, advertising, publicity, and promotional purposes without compensation (unless prohibited by law) by Sponsor and those acting pursuant to Sponsor's direction, in each case in all media now known or hereafter discovered, worldwide, including but not limited to the World Wide Web, without notice, review, or approval and agrees to execute specific consent to such use if asked to do so. All federal, state and local taxes are the sole responsibility of winner. Participation in the contest and acceptance of a prize constitutes the winner's permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by winner regarding the contest or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.
By participating, entrants, and winners agree to release and hold harmless Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with contest, or possession, acceptance and/or use or misuse of prize or participation in any contest-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if contest cannot take place or if the prize cannot be awarded due to interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this contest in any way shall be disqualified.
8. Additional Terms. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the YouTube channel associated with the winning entry. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the contest, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this contest or downloading any materials in this contest.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this contest should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the contest. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the contest or web site. Sponsor may prohibit an entrant from participating in the contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
